BACKGROUND ON DOCTOR'S AGREEMENT

 

This agreement outlines the expected performance parameters and the quality of service in terms of consultation, referral, ordering of prescription and supply, and payment for products and services. It is also clear on the state the product should be when ultimately getting to the patients. It will seek to address issues of operations and clearly stating the responsibilities of every party.

OBJECTIVE

• To ensure all time availability and accessibility.

• To improve on timely delivery of service/drug.

• To agree payment terms and to ensure business continuity.

• To define responsibilities as it relates to calls, consultations, doctor’s activities and drug delivery to patients.

 

SCOPE

This agreement covers all issues – online consultations, chats (video, audio and text), referral, supply of drugs from pharmaceutical stores, and also collection of payment from the patients and payment to service providers.

 

DURATION OF AGREEMENT

This agreement shall subsist from the date of execution for a period of 12 calendar months from the date thereafter and may be renewed by the parties upon its expiration. It shall remain enforceable until it is reviewed or elapsed.

REVIEW

This agreement can be reviewed three months after it is operational, and review shall be at the instance of any of the party to the agreement. It shall be deemed enforceable upon agreement to the items of amendments duly signed off by all the parties.

OBLIGATIONS OF TALKTOMEDOC

• To provide a platform for all service providers in manner agreeable to all applicable laws and regulations.

• Provision of marketing aids and promotional activity that is deemed appropriate to service providers.

• Organize at its sole discretion regular visits to check on state of equipment and facility.

• Ensure regular payment due to all providers.

 

OBLIGATIONS OF DOCTORS

• Ensure the best customer service at all time.

• Extend courtesy to all patients.

• Referral should be done with the patient interest at heart.

• When referral is to be made the following factors should be considered:

(i.) Location,

(ii.) area of specialty of the hospital,

(iii.) Consultants and hospitals they are affiliated with.

(iv.) Consultation fees

• All prescriptions are to be sent to signed up pharmacies, and at no time should pharmacies not registered on the platform be allowed to supply drug to our patients.

• Doctors are only permitted to direct all referrals to signed up/accredited hospitals, and at no time should pharmacies not registered on the platform be allowed to supply drug to our patients.

• Cooperation with TalktomeDoc or its representatives.

• Act ethically and professionally as set by MDCN.

• For no reasons should doctors be involved in diversion of patient from our platform to any individual, corporate including themselves.

• Any relationship with patient should strictly professional and no personal relationship should be created through your involvement with TalktomeDoc platform with of our patients, i.e. no exchange of personal contact numbers, email addresses, etc.

Default on obligations

• Failure to uphold all obligations stated above TalktomeDoc has the right to penalise service providers.

The penalties may include but not limited to the following:

(i.) Failure to upload patient’s investigation summary will attract a fine of ₦10,000 in the first instance.

(ii.) In the second instance temporary removal from our platform.

(iii.) In the third instance, removal from our platform until further notice.

• Doctors who call, text, WhatsApp, or contact patients using their own mobile in any way at the end of a consultation, will be rejected from the platform immediately.

PAYMENT TERMS

A monthly payment system will be operated, all payment for previous month’s activities will be paid the first week of every month; Payments will be made by either cheque or electronic transfer every week on invoice due.

OTHERS

The Patients shall be liable for all losses or damage caused to drugs in their custody.

 

EXECUTION OF THE AGREEMENT

This agreement has been read and accepted by the authorized representatives of the parties the day and year first above written.
